Server Falls Off Forklift, Spurs $1.4M Suit

Be careful moving that server! A federal contractor is suing IBM after a server fell off a forklift and was irreparably damaged while it was being moved into the customer's facility last October. T.R. Systems is suing IBM for $1.4 million, which it says was the value of the server that was ruined, according to Information Week.

The lawsuit describes the gory details of what happened when the company tried to transport the server from a delivery truck into its warehouse in Alexandria, Va.: "The rear wheels of their forklift hit the raised surface at the entry door of the warehouse, causing the forklift to rock, and subsequently causing the server to rock. As a result of the rocking motion, the base of the pallet and the crate broke and the crate fell onto the curb, damaging the server packed inside." Are you getting a visual in which this is happening in excruciating slow motion? I know I am.

The lawsuit doesn't identify the model of the server. T.R. Systems says IBM refused to take back the damaged equipment, forcing the company to buy a replacement unit. T.R. Systems is alleging that the damage to the server was caused by "defective packaging" by IBM.

Question 1. Who was operating the forklift? IBM rep, or TR Systems person, or Facility employee?
Question 2. What was the Height that it dropped from? 1 Foot... probably IBM is responsible.
4 Foot and landed on it's top or side?
Probably the Facility or TR Systems.

Question 3. 1.4 Million, and no 'Safety Belt' around the computer while being moved?
